Terms of Service Agreement with K9-Clean Dog Waste Management Solutions

This Terms of Service Agreement (the “Agreement”) is entered into by and between K9-Clean Dog Waste Management Solutions, a Nova Scotia corporation, located at 153 North St Bridgewater NS (“Service Provider” or “we”), and the undersigned customer (“Customer” or “you”). By using the dog waste removal services provided by K9-Clean Dog Waste Management Solutions, you agree to the following terms and conditions.
1. Services Provided
The Service Provider agrees to perform dog waste removal services (“Services”) at the location specified by the Customer. Services may include the removal of dog waste from the yard, disposal of waste, and the sanitation of the area. The specific frequency and scope of services (e.g., one-time, weekly, bi-weekly) will be outlined in the Customer’s order or service agreement.
2. Access to Property
Customer agrees to provide reasonable access to the property where the services are to be performed. This includes ensuring the area is clear of obstructions, gates are unlocked, and paths to the yard are accessible.
- Leaving the Dog Inside: The Customer agrees to keep the dog(s) inside or otherwise securely contained during the time of service. The Service Provider will not be responsible for any interactions with the dog(s) while on the property. The Customer should ensure that the dog(s) do not pose a threat to the Service Provider or interfere with the work being performed.
- If the Customer is unable to secure the dog(s) inside, the Service Provider reserves the right to cancel or reschedule the appointment at their discretion.
3. Pricing and Payment
Customer agrees to pay for services rendered according to the pricing structure provided by the Service Provider. Prices are subject to change, and any changes will be communicated to the Customer in advance. Payment is due upon completion of the service unless otherwise agreed. Late payments may incur additional charges.
- Payments can be made via all major Credit Cards, Interact, Cash or E-Transfer.
4. Customer Responsibilities
- The Customer is responsible for ensuring that the area where services are performed is safe and free from hazards that could pose a risk to the Service Provider or damage equipment.
- The Customer must ensure that any dogs are kept securely inside the home or in a safe, enclosed area during the service.
- The Customer is responsible for providing the Service Provider with accurate instructions on the location and any specific concerns related to the yard.
5. Service Cancellations and Rescheduling
- The Customer may cancel or reschedule services with at least 24 hours’ notice. Failure to provide adequate notice may result in a cancellation fee.
- If the Service Provider arrives and is unable to complete the services due to the dog(s) being outside or inaccessible areas, the Service Provider may charge a trip fee or reschedule the service.
- If the Service Provider needs to cancel due to weather conditions or other unforeseen circumstances, the Service Provider will attempt to reschedule the service promptly.
6. Liability
The Service Provider will perform the services with reasonable care and skill. However, the Service Provider is not responsible for:
- Any damage to the yard, property, or fixtures unless directly caused by the Service Provider’s actions.
- Any injury caused by the dog(s) or any other animals on the property.
- Conditions or hazards that were not disclosed by the Customer prior to service.
7. Termination
Either party may terminate this Agreement with written notice. Upon termination, any outstanding payments for services performed will become due immediately. In the event of a breach of these terms by the Customer, the Service Provider reserves the right to suspend or terminate services at their discretion.
8. Indemnification
The Customer agrees to indemnify and hold harmless the Service Provider from any claims, damages, liabilities, and expenses arising from the Customer’s failure to adhere to these terms, including failure to secure the dog(s) or disclose hazards.
9. Privacy
The Service Provider will maintain the confidentiality of Customer information in accordance with privacy laws and regulations. Personal information will not be shared with third parties without the Customer’s consent, except as required by law.
10. Amendments
The Service Provider reserves the right to amend this Agreement at any time. Customers will be notified of any material changes, and continued use of the services after such changes shall constitute acceptance of the updated terms.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Province of Nova Scotia, without regard to its conflict of law principles.
